Privacy Notice

Pursuant to Articles 2, 8, 15, 16, and 36 of the Federal Law on Protection of Personal Data Held by Private Parties, and Articles 3, 4, 26, 27, 28, and other applicable provisions of its Regulations, GAIA® issues this Privacy Notice:

You are hereby informed that GAIA®, with tax domicile at José María Vigil 2882, Suite 400-A, Col. Lomas de Providencia, C.P. 44647, Guadalajara, Jalisco, Mexico, is responsible, in accordance with the above-referenced Law, for the processing of your personal data.

Accordingly, we inform you of the following:

1. PURPOSE OF PERSONAL DATA

Your personal data will be used for the following purposes:

The purpose of personal data protection is to ensure that third parties use your personal data with due respect, so that you may retain control over such data and know at all times who processes it, why it is collected, how it is processed, how it is used, and to whom it may be transferred or disclosed.

When processing personal data, GAIA® will rely on the principle of consent from its clients. This principle may be regarded as the legitimizing basis for processing. Such “consent” (which is unrelated to “informed consent”) allows the data subject to exercise control over the use of their personal data.

2. COLLECTION OF PERSONAL DATA

For the purposes stated in this Privacy Notice, we inform you that we collect your personal data directly from you when you provide it to us through various means, whether when visiting our offices, by telephone, or by email, for the purpose of providing the contracted service.

The data we obtain through these means may include, among others: full name, tax address, home address, Federal Taxpayer Registry number, Employer Registration number, data relating to real estate, data relating to movable property, landline and mobile telephone numbers, email address, or data related to the administration of your company, such as contribution payment amounts and dates, accounting data, etc.

Likewise, we undertake to treat such data under the strictest security measures to ensure its confidentiality.

3. SENSITIVE PERSONAL DATA

In this regard, please be informed that, in accordance with Article 3, Section VI of the Federal Law on Protection of Personal Data Held by Private Parties, and in view of the services offered by GAIA®, no data considered sensitive will be collected.

4. ACCESS TO OR RECTIFICATION OF PERSONAL DATA, AND CANCELLATION OR OBJECTION TO ITS USE

We also inform you that you have the right to access the personal data held by GAIA® and the details of its processing, as well as to rectify it if it is inaccurate or incomplete; cancel it when you consider that it is not required for any of the purposes stated in this Privacy Notice, is being used for purposes not consented to, or the contractual or service relationship has ended; or object to its processing for specific purposes.

The mechanisms implemented for exercising such rights consist of submitting the corresponding request in writing with a handwritten signature, addressed to the customer service area, or by email sent to the following address: luis.chalita@gaiamx.com. In either case, GAIA® will acknowledge receipt of your request.

Such request must contain the data you wish to rectify or cancel, or whose use you oppose, as well as the reasons for your request. The period for responding to your request will be 15 business days counted from the acknowledgment of receipt of your written request or email.

5. REVOCATION OF CONSENT FOR THE PROCESSING OF PERSONAL DATA

At any time, you may revoke the consent you granted to GAIA® for the processing of your personal data, so that we cease making use of it. To do so, it is necessary to submit your request in writing with a handwritten signature addressed to the customer service area, or by email to the following address: luis.chalita@gaiamx.com. In either case, receipt of your request will be acknowledged.

Such request must contain the data for which you are requesting revocation of processing, the reasons for your request, as well as an express statement of revocation. The period for responding to your request will be 15 business days counted from the acknowledgment of receipt of your written request or email. Within such period, GAIA® will respond to your request in writing, to be delivered personally at our offices located at José María Vigil 2882, Suite 400-A, Col. Lomas de Providencia, C.P. 44647, Guadalajara, Jalisco, Mexico.

6. TRANSFER OF YOUR PERSONAL DATA

You are informed that your personal data may be transferred and processed within and outside the country by persons other than this company. In that regard, your information may be shared with GAIA®’s different offices for the purpose of providing the services contracted, if such services must be performed in other parts of the Mexican Republic.

We undertake not to transfer your personal information to third parties without your consent, except for the exceptions provided in Article 37 of the Federal Law on Protection of Personal Data Held by Private Parties, and to carry out such transfer in the terms established by that law.

If you do not express your objection to the transfer of your personal data, you will be deemed to have granted your consent to such transfer.

7. CHANGES TO THE PRIVACY NOTICE

GAIA® reserves the right to make modifications or updates to this Privacy Notice at any time, in response to legislative developments, internal policies, or new requirements for the provision or offering of our services or products.

8. COMPLAINTS AND REPORTS REGARDING IMPROPER PROCESSING OF YOUR PERSONAL DATA

If you consider that your right to the protection of personal data has been infringed by any conduct of our employees or by our actions or responses, or if you believe that the processing of your personal data violates the provisions of the Federal Law on Protection of Personal Data Held by Private Parties, you may file the corresponding complaint or report with the IFAI.
